This page explains the terms of use of the WPdesignhost.com.au website, trading as WP Design Host, including all subscription or purchasable products or services offered by WP Design Host, and binds you in agreement and acceptance to the following terms and conditions (Terms of Service):
Product & Services Description
WPdesignhost.com.au is an online hub supplying design, maintenance, and support services exclusively for WordPress CMS-driven websites. This includes all products and services advertised on WPdesignhost.com.au or offered otherwise by WP Design Host to individual clients.
WP Design Host reserves the right to suspend or cancel any service at any time at its sole discretion and without prior notice unless where stipulated within any individual terms.
Authorisation
You, the client, engage WP Design Host as a contractor to perform services work as outlined in the products or services you have subscribed to or purchased. Access to your website via the administration dashboard of your website or hosting account will be required to facilitate carrying out services. You agree to permit WP Design Host authorisation to access and modify site directories, file structure, and/or the database of your website.
Copyright Law
WPdesignhost.com.au takes no responsibility for your legal interests. It is the responsibility of you, the client, to ensure that informational content and any media of any kind comply with copyright law and you are permitted to publish all information and media provided by you, the client.
Limitation of Liability
In no event shall WP Design Host be liable under contract, negligence, tort, strict liability, or other legal binding not expressly written within these terms, with respect to the website, any services provided or purchased, for any client losses whether indirect, punitive, incidental, special or any damages of any kind whatsoever.
Support Requests
General support including any communication or any contracted once-off or scheduled technical labor must be through accepted communication methods and must be directly related to your WordPress website and those services or product inquiries advertised and offered through the website, or quoted directly from WP Design Host employees only. Support requests must directly relate to the website associated with any client account, and are responded to within 12 to 24 hours, excluding weekends or public holidays which may be longer. Scheduled Services
(Once-off, Annual, Quarterly, or Monthly packaged subscriptions) Plugin Update, Theme Upgrade, Website Security and other product subscriptions purchased entitles you to either a once-off, monthly, quarterly, or annual support and maintenance. If more than the quoted services advertised are required in any scheduled time period, additional professional labor to complete the required work can be requested, and a fee for service supplied before both parties’ agreement to carry out the tasks.
Professional labor outside of any advertised subscription plans, products, or already contracted services can be discussed and purchased at a rate of $75 per hour or based upon an agreement to commence work after approving a supplied quotation for service.
Each subscription package or any WP Design Host service is for one website only.
WORDPRESS PLUGIN UPDATES, THEME UPDATES, WEBSITE SECURITY IMPLEMENTATIONS, MALWARE REMOVAL
All plugin updates, thee upgrades, website security implementations or malware removal will generally be completed within a maximum of 7 business days of product / service / subscription purchased, with exception made where is required. Priority of service is given to whatever is deemed most highest priority by WP Design Host. WP Design Host performs a duration of professional labour that equates to what is initially expected to be performed based on the product / service / subscription purchased by the client. If specific updates, upgrades or implementations cannot be adequately completed within the time WP Design Host deems as a reasonable amount of time, then the client can either have further work carried out at a negotiated price for service, or we can restore the client website back to the state before the service was implemented. Refunds will not be given if professional hours have been performed on the website to the value WP Design Host deems to be adequate based upon any product / service / subscription purchased by the client.
DESIGN SERVICE
WP Design Host will make every attempt to carry out any contracted work within a given timeframe quoted, however where permitted due to unforeseen circumstance can be longer than initially expected or quoted. All professional hours accrued in the performance of work on behalf of a client are attributed toward a visualised number of hours WP Design Host reasonably expect are required in order to complete the work. WP Design Host will under no circumstance be liable for any compensation for any reason the client argues upon delivery of a design service, however will try to negotiate and or facilitate some changes to further bring inline the design to what the client’s expectation of the service is, though only to the extension of time WP Design Host deems a reasonable attribution of extended time.
CANCELLATION & REFUNDS
Subscriptions
Cancellation by client of any recurring scheduled service can occur at anytime after completion of an initial year subscription. All scheduled services / products are based on offering a minimum of one year of service. A minimum of two weeks prior to the end of any year is required to cancel any update, upgrade or scheduled service.
Services
No refunds are available after your purchased website package or service deposit has been paid and work has commenced, unless otherwise specified in any authorised promotional materials and marketing campaigns or directly expressed and documented by WP Design Host.
Any service payment terms will be specified within any given quote or invoice for service and are binding to our strict terms of service.
PROMOTIONS & ADVERTISING
Promotional offers and advertising may be sent to any client of WP Design Host unless expressly agreed to upon any clients direct documented or agreed request. WP Design Host also reserves the rights to display third party advertisements on the website.
PRICING & PAYMENTS
All prices appearing on this site are subject to change without notice. If prices for products or service of WP Design Host on the WPdesignhost.com.au website change, new subscription costs will be updated on the website and advertised on the website. Should a client already be subscribed to a recurring service on a billing cycle the client will be notified of any price changes with a minimum of 2 weeks notification. Clients will not be charged any new pricing for any current subscription a client has already paid for and purchased if price structure for any scheduled subscription service changes.
SERVICE REFUSAL
WP Design Host reserves the right to refuse service to any website or individual. Websites containing offensive, pornographic, hateful or malicious content can be refused service without any notice.
HOSTING SERVICE HOSTING SETUP
It is your responsibility to ensure that any applied hosting package order application is completed in order to be activated and ready for full use. We do not guarantee or imply activation of any client account within a specific quoted time frame. We may delay or refuse activation of a client hosting account if:
We believe the order, information or payment is fraudulent. Payment is not cleared or received in full. The domain name quoted does not exist, is in a non-usable state (e.g pending renew) or deemed to be proposed for use that voids our Acceptable Use policy. You have any funds outstanding with relation to any other account. There is any other reason which we deem satisfactory.
We may send notification of hosting activation however:
Your contact details must be correct and up to date. This is not final word that your hosting is fully active and ready for use, you must ensure the hosting is fully functional.
You release us of any claim arising from failed hosting activation whether at fault of our system, our staff or any other factor out of our reasonable control.
SERVICE LEVELS
WP Design Host will endeavor to maintain network stability and satisfactory service levels, however, you irrevocably agree that:
We may from time to time perform routine maintenance, service and upgrades. We will endeavor to act on such instances at the most convenient times and provide reasonable notice by any means we deem satisfactory. We may experience outages beyond our control caused by any of the following; force of any ‘act of god’ including those induced by negative human activities), war, invasion, act of hostilities, civil war, rebellion, military power or confiscation, terrorist activities, nationalism, government / sanction, restraint, prohibition or intervention, blockage, labor dispute, strike, lockout or failure of utilities (electricity, telephone, etc), failure of hosting hardware, failure of software, hardware upgrade mal-function or any other failure as caused by us, our suppliers, or any third party You release us from any claim or potential claim with relation to outages and any loss of business / service suffered by you or any third party. We may, at our discretion, provide notification of outages whether planned or unplanned.
SUSPENSION & CANCELLATION
You expressly and irrevocably agree that we reserve the right to suspend/cancel any/all Service if:
You have any outstanding invoice or account. Your account is in dispute or dispute resolutions procedure, court order, judgment, findings, or determination. You fail to comply with any provision in this agreement or those referenced in this agreement. There is evidence of illegal, defamatory, fraudulent, offensive activities, or any activity in breach of a third party’s rights. We deem your use of our services may put undue risk to the operation of the service, us or our suppliers. We deem any other reason satisfactory to protect us, our staff and or our suppliers.
